1. Background

China Quality Focus Limited, hereunder called "CQF", is a Hong Kong limited company, acting as a consultant for quality purposes. CQF acts in the capacity of an independent third party, on behalf of its clients and offers quality control services for importers buying products in China.

2. Access to this Site

This Site is owned and operated by CQF. CQF grants you a limited license to access and make personal use of its website. It is not allowed to download (other than regular and proposed documents), or to modify any portion of the website, except with the express written consent of CQF.

This license does not include any resale or commercial use of the website or its contents. Collection and use of information such: product listings, descriptions or pricing is forbidden. Any derivative use of the website or its contents such as downloading or copying of account information, using of data mining, robots or similar data gathering and extraction tools are strictly forbidden. The website or any portion thereof is not allowed to be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without the express written consent of CQF.

Framing or any other assimilated framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, video, sound, scripts, page layout or form) is not allowed without the express written consent of CQF. You may not use any Meta tags or other "hidden text" using CQF' name (China Quality Focus) or trademarks without the express written consent of CQF. Any unauthorized use terminates the permission or license granted by CQF could sue you

CQF may not be responsible for any damages occurred on the client’s computer trough the using of the CQF’s website or files provided by CQF.

3. General

Every time you use or access to this website, you agree to be bound by these Terms & Conditions.

You agree that the owners of this web site (CQF) exclusively reserves the right and may, at any time and without notice modify or discontinue this web site and its services or delete the data you provide.

We shall have no responsibility or liability for the timeliness, deletion, failure to store, inaccuracy, or improper delivery of neither any data nor information.

4. Services

CQF services, hereunder called "services", include but are not limited to:

  • Product inspections (Pre Production Inspection, First Article Inspection, During Production Inspection, Pre Shipment Inspection, Final Random Inspection, Container Loading Inspection).
  • Factory audits (Factory Evaluation, Factory Audit, Social Audit, C-TPAT audit)
  • Defect sorting
  • Production monitoring
  • Management of Laboratory testing on behalf of importers in order to obtain the relevant certifications.

CQF will perform its services on behalf of the client and CQF will do its best to ensure that services are performed in a professional and reliable manner.

5. Performance of services

The performance of the Service will consist in a document, hereunder called the "Report". The Report will display the collection of information that CQF has been requested to supply and will be delivered as an online report, sent by email and posted online on the client account, also called “dashboard”.

CQF acts as a third party but still perform its services on behalf of the client. Our role is to get information in the factory for preventing any quality issue related to our clients' production and for which our clients request a service.

CQF will carry out its services according to client's specifications made on the online booking and after validation by CQF. In the case where there is no client's specification, CQF will use the relevant and / or available standard(s) or common practices to perform its services.

Client should book its demand(s) online from its private account, as much as possible in advance.

CQF keeps the right to accept or reject a demand of service or a request of any kind and cannot be sued or considered liable if do so.

6. Client's obligations

The Client agrees to supply CQF with relevant, true and correct information when ordering the services either online from its private account on CQF website or through email(s) sent to his account manager.

Moreover, the client shall ensure that CQF will access the needed information not later than 48h before the desired service.

Client cannot modify his order within 24H prior to the day of the performance of the service.

Clients may cancel the desired service but not after 3PM China time the day before the requested and planned service date, otherwise CQF will charge the service entirely (full fee) to the client and will be released from its obligations

Client accepts to abide to our payment and invoicing policy.

7. Payments and Invoicing policy

For new clients, services have to be paid prior to the services.

For regular clients, invoices will be sent by email, once a month, at the end of the month, with all services performed during the month and the payment is requested right away, upon receipt.

When transferring the money with its bank, the client agrees to pay its own bank fees, charges and expenses.

Client will pay the ordered services fees to CQF by bank transfer (TT / telegraphic transfer of money, from bank to bank). Services fees are usually labeled in Euros; however client can request to have its private account on CQF website to be settled in USD and thus can be invoiced in USD.

In case the client did not pay his previous invoice(s), CQF has all right to stop providing its services and the client still need to paythe amount related to the services performed by CQF. Moreover, an extra charge of 3% of the due amount will be charged for every month of late payment.

For orders invoiced with additional expenses (travel expenses for orders outside of our network or orders performed by Western inspectors), these orders will be charged based on real travel expenses (receipts will be provided). If the payment had occurred prior to the service, an advance for travel expenses might have been charged. In this case, the client will have to pay for real travel expenses and we will deduct the advance from his next invoice.

8. Liability and indemnification

8.1 Limitation of liability

CQF will accept liability only in case of proven negligence.

CQF is not an insurance company and refuse to bear such a role. Clients who want to ensure their goods against bad quality, problem of shipments; inadequate material etc should look for a proper insurance through an insurance company.

CQF will do its best to perform its services with due diligence and will perform it services based on the client's instructions. These instructions are given online through the online booking filled by the Client. Thus, CQF will issue the Report relating to the facts as recorded by it within the limits of the instructions and criteria sent by the client.

Hence, CQF is under no obligation to report information that is not requested by the client through its online-booking. Moreover our services do not include the checking of the internal mechanics, the safety requirements, the chemical testing of products or the exact materials to be used to produce the goods. Such check could be done through our lab testing services with our accredited laboratories partners in China.

If CQF is not able to perform its services due to any reason out of its control, client cannot make CQF responsible for this.

If an inspection has been performed when less than 50% of the products were ready and the result was failed, and if no re-inspection nor defect sorting was booked by the client after the first inspection, CQF will not accept any claim about the final goods.

8.2 Indemnification

If CQF is proven responsible for a loss or damage of any kind, CQF's liability to the client and to any other party shall not exceed ten times the total fees paid the client for the specific concerned service and for which a claim has been made. Moreover, our liability can only be engaged for the specific products that CQF inspected at the time of performance of the service.

Thus, if the amount of loss and claim is above CQF’s liability (as defined above), the client shall bear the difference between CQF's liability (as defined above) and the amount of loss (the price of the claim), and this for all claims made by other parties (including the client and its final clients) against CQF.

If client has a claim or a loss to declare, notice must be given to CQF headquarters (info@chinaqualityfocus.com or by mail at China Quality Focus Limited located at Rooms 13-18-20, 13/F, Hollywood Plaza, 610 Nathan Road, Mongkok, Kowloon, Hong Kong) within 1 week following discovery of the facts, or within two months from the completion of the CQF Service.

9. Termination of services

CQF has the right to suspend or terminate the provision of services to the client at any time.

Provision of services will be automatically suspended in case where client does not follow these terms and conditions or if client does not pay or is unable to pay.

10. Supplier & Factory obligations

The report is not a certificate for the supplier and is not an evidence for shipment(s). The issuance of the report does not exonerate the buyers from exercising all their rights and does not release the manufacturer or seller from his contractual liabilities and responsibilities for its products.

11. Employment Offers

This website may contain information on employment opportunities within CQF. If you decide to apply for a vacancy we will assume that, by creating an application form or sending us your CV, you are signaling your agreement for CQF to use, hold and destroy any personal data contained in your form/CV for the purpose of considering your application in accordance with our standard recruitment procedures and for the purposes outlined in detail below.

We may wish to retain your details on file for up to the next 12 months and to notify you of any suitable vacancies that arise. You would then have the opportunity to apply for these vacancies if you wished to do so.

We may use your personal information for purposes of market research, specifically relating to the improvement of recruitment and HR policies and practices.

12. Jurisdiction

These terms and conditions are governed by and construed in accordance with the Hong Kong Law. Thus all disputes shall be submitted to the jurisdiction of the courts of Hong Kong or/and in the country where the client is located.

13. Copyright

The information contained on this website or in any publication made available on or through this website is the exclusive property of CQF. It is licensed to CQF and is protected by copyright and other proprietary rights. Nothing contained in this website or in any documents (reports, invoice, poster, flyer, business card) created and provided by CQF may be reproduced, distributed or edited in any manner without the prior written authorization of CQF.

14. Disclaimer

The information contained and accessed on or through this website is provided by CQF for general guidance and is intended to offer you general information of interest. CQF owns or licenses all text, data, images, logo and other materials on the Site. CQF has made every effort to ensure that the information contained on this Site is accurate and reliable. However, errors may sometimes occur. Therefore CQF expressly disclaims all express or implied warranties of any kind as to any matter whatsoever relating to these pages. In no event shall CQF be liable for any indirect or consequent loss or damage (whether for loss of profit or otherwise) arising out of or in connection with the use of this website.
